General Terms and Conditions (Allgemeine Geschäftsbedingungen) of SilverBridges GmbH
The online shop https://shop.wideluxx.com/ is an offer of SilverBridges GmbH, Soonwaldstraße 21, 55494 Rheinböllen, registered in the commercial register of the local court Bad Kreuznach under HRB 24214.
SilverBridges GmbH is hereinafter also referred to in short as “SilverBridges”.
In this online shop, consumers as well as commercial customers (hereinafter also referred to as “customers/you/your”) may conclude legally binding purchase contracts for personalised, custom-made mechanical high-end cameras, such as the WideluxX™ (hereinafter – regardless of the product specification – referred to as “WideluxX™”) and accessories.
WideluxX™ is a trademark of SilverBridges GmbH.
1. Scope of Application
1.1. These General Terms and Conditions (hereinafter referred to as “GTC”) apply to all contracts concluded with our customers regarding the goods offered in the online shop of SilverBridges GmbH. These GTC apply regardless of whether the customer is a consumer, entrepreneur, or merchant.
1.2. All agreements made between you and us in connection with the purchase contract arise in particular from these GTC, our order confirmation, and our declaration of acceptance.
1.3. A consumer is, pursuant to § 13 BGB, any natural person who concludes a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity.
1.4. The version of the GTC valid at the time of conclusion of the contract shall be authoritative. The contractual text including these GTC is stored by SilverBridges after conclusion of the contract and is accessible to the customer via their customer account as well as as an attachment to the order confirmation by e-mail in a permanently storable form (§ 312i para. 1 no. 4 BGB, Art. 246c no. 2 EGBGB).
1.5. These GTC apply exclusively. We do not accept any deviating conditions of the customer. This also applies if we do not expressly object to their inclusion.
2. Pre-Sale and Structure of these GTC
2.1. Part I exclusively governs the pre-sale of the WideluxX™ model “WideluxX™ Panoramic Camera” and contains in particular provisions on the pre-order process, the right of cancellation as well as delivery within the scope of the pre-sale, and takes precedence as a special provision over the provisions of Part II. To the extent that the provisions of Part I do not contain any deviating provisions, the general contractual conditions of Part II shall apply additionally and subsidiarily.
2.2. Part II contains the general contractual conditions that apply to all contracts concluded via the online shop of SilverBridges GmbH.
PART I – Pre-Sale
1. Pre-Sale
1.1. Part I of these GTC contains the special provisions for the pre-sale of the WideluxX™ Panoramic Camera.
1.2. Via the online shop, SilverBridges offers the WideluxX™ Panoramic Camera in a limited quantity within the scope of a pre-order phase (hereinafter “pre-sale”). Interested parties may place a binding pre-order for the WideluxX™ before production has commenced. SilverBridges will produce and deliver all pre-orders placed within the scope of the pre-sale in accordance with these GTC.
1.3. The agreed characteristics of the WideluxX™ are determined in accordance with clause 3.
1.4. In the pre-sale, customers have extensive individualisation options, which are further governed in this Part I: prior to placing the order, the selection of an individual monogram or initials as a fixed and mandatory component is required; only with this mandatory individualisation (Pflichtindividualisierung) can the order be completed and full payment including shipping costs be made. The customer will be informed in due time about the further course – in particular the later coordination of additional equipment details upon production readiness as well as the notification of production and shipping readiness by SilverBridges.
2. Conclusion of Contract (Vertragsschluss) – Pre-Sale
2.1. The presentation and advertisement of the limited WideluxX™ Panoramic Camera within the scope of the pre-sale in our online shop does not constitute a legally binding offer to conclude a purchase contract. Rather, it constitutes an invitation to you to submit a binding order.
2.2. Before placing your order, you will be requested to bindingly provide your personal monogram or initials for the engraving of the WideluxX™. The provision of the monogram or initials is a mandatory component of the order and a prerequisite for its completion. Without the provision of this mandatory individualisation, no order can be placed.
2.3. Immediately before placing your order, the following information will be prominently displayed to you, which you must expressly confirm by actively clicking (placing a tick): (a) I confirm that the WideluxX™ is individually manufactured according to my personal specifications (in particular engraving of my monogram/my initials) and that therefore, pursuant to § 312g para. 2 no. 1 BGB, no statutory right of withdrawal (Widerrufsrecht) exists. (b) I acknowledge that upon production readiness, SilverBridges will contact me to coordinate further equipment details (e.g. leather, controls, lenses, colours) and that I will then bindingly confirm these additional individualisation requests. (c) I confirm that by placing the order I incur a payment obligation in the amount of the displayed total price including shipping costs. d) I acknowledge that the images shown depict pre-production models and that the final product supplied may differ from them in terms of visual and technical details.
2.4. By clicking the button “Order now with obligation to pay” (“Jetzt zahlungspflichtig bestellen”), you submit a binding offer to conclude a purchase contract and expressly confirm that you undertake to make immediate full payment of the purchase price plus shipping costs.
2.5. After receipt of your order and full payment, you will receive from us an automatic acknowledgement of receipt by e-mail. This acknowledgement of receipt does not yet constitute acceptance of your offer, but serves exclusively to inform you of the receipt of your order and contains the information about SilverBridges as well as these GTC required by law in the event that a contract is concluded. The acceptance of the contract by SilverBridges is effected by a separate order confirmation by e-mail.
2.6. To the extent that the ordered WideluxX™ cannot be produced at all or in the desired version, you will be informed of this without delay. In this case, a contract is not concluded; payments already made will be refunded without delay.
2.7. As soon as the production of your WideluxX™ has reached the corresponding production readiness, SilverBridges will contact you in order to jointly and bindingly coordinate further equipment details. These include in particular, but not exclusively: selection of controls (e.g. buttons, leather), lenses, colours and further design details. The coordination of these further individualisation details takes place within the scope of the already existing purchase contract and constitutes a supplementary agreement. SilverBridges will present the coordinated details to you for confirmation.
2.8. Since the WideluxX™ is individually manufactured according to your customer specifications on the basis of the mandatory individualisation (monogram/initials engraving) compulsorily provided by you prior to the order, no statutory right of withdrawal (Widerrufsrecht) exists pursuant to § 312g para. 2 no. 1 BGB. You were expressly informed about the exclusion of the right of withdrawal (Widerrufsrecht) prior to placing your order and confirmed this by actively clicking. Until the submission of your order, you may cancel the ordering process at any time. After placing the order, the right of cancellation (Stornierungsrecht) pursuant to clause 5 of this section applies.
3. Pre-production images and agreement on quality
3.1. The product images used in the online shop show prototypes of the WideluxX™ and are intended solely to illustrate the product design. They do not constitute a binding agreement on quality within the meaning of Section 434(1) of the German Civil Code (BGB) for the production version of the product.
3.2. The delivered product may differ from the images shown in terms of visual and technical details, insofar as this is necessitated by manufacturing requirements or by changes made during series production. Such deviations do not constitute a material defect, provided they do not affect the characteristics decisive for the purchase referred to in clause 3.3.
3.3. The essential, purchase-determining characteristics of the WideluxX™ remain expressly unaffected by the above reservation regarding deviations. These are, in particular:
- the basic mechanical function and core specifications of the camera,
- the contractually agreed quality,
- the features individually configured by the customer (in particular monogram/initial engraving and details specified during the customisation process).
3.4. The customer is expressly and clearly informed of the pre-production nature of the images before and during the ordering process. By actively confirming during the ordering process, the customer acknowledges the possibility of manufacturing-related variations in detail.
3.5. This reservation regarding deviations does not apply to changes made unilaterally by SilverBridges after the conclusion of the contract which affect essential, purchase-determining characteristics as set out in clause 3.3. The customer’s statutory rights in the event of material defects pursuant to Sections 434 et seq. and 437 et seq. of the German Civil Code (BGB) remain unaffected.
4. Delivery Period – Pre-Sale, Maximum Delivery Period
4.1. The dispatch of the first units is planned for a period of a maximum of twelve (12) months after the commencement of the pre-order phase. The estimated individual delivery period for the customer will be communicated to the customer separately prior to conclusion of the contract and is based on the order in which pre-orders were received as well as the progress of the individualisation coordination pursuant to the following provisions of these GTC. The customer will be notified without delay of unavoidable delays, in particular in the case of supplies or in production.
4.2. Should the delivery of the WideluxX™ to the customer not take place within twelve (12) months of the commencement of the pre-order phase (hereinafter “maximum delivery period” (maximaler Lieferzeitraum)), the customer shall have the right to demand full reimbursement of the purchase price already paid, without the need for a notice of termination or any other declaration. The reimbursement shall be made without delay, but at the latest within fourteen (14) days of the customer asserting the reimbursement claim, using the same means of payment that the customer used for the original payment.
4.3. This voluntary right of reimbursement leaves unaffected the customer’s further statutory rights – in particular the statutory right of withdrawal from contract (gesetzliches Rücktrittsrecht) pursuant to §§ 323 ff. BGB as well as the right to termination of contract in accordance with the applicable consumer protection provisions (verbraucherschutzrechtliche Vorschriften).
5. Right of Cancellation (Stornierungsrecht) of the Consumer Prior to Commencement of Production
5.1. The consumer has the right to cancel the order within two weeks (14 days) of placing the order in text form (Textform) (e.g. by e-mail).
5.2. The cancellation is to be addressed to SilverBridges GmbH, Philippstraße 10, 55543 Bad Kreuznach, e-mail: cancellations@wideluxx.com. To observe the deadline, it is sufficient to send the declaration in time.
5.3. If the cancellation is effectively made within the aforementioned period and before the camera has been produced according to the individual specifications of the consumer, payments already made will be refunded without delay.
5.4. The above-mentioned possibility of cancellation of the customer’s order exists exclusively for the benefit of consumers within the meaning of § 13 BGB.
PART II – GTC
1. Conclusion of Contract
1.1. The presentation and advertisement of the WideluxX™ in our online shop does not constitute a legally binding offer to conclude a purchase contract. Rather, it constitutes an invitation to you to submit a binding order for the WideluxX™ and/or other products of SilverBridges.
1.2. By clicking the button “Order now with obligation to pay” (“Jetzt zahlungspflichtig bestellen”), you submit a binding offer to conclude a purchase contract.
1.3. After receipt of your pre-order, you will receive from us an automatic acknowledgement of receipt by e-mail, which does not yet constitute acceptance of your offer. It serves merely to inform the customer of the receipt of the order and contains the information about SilverBridges as a potential purchase contract partner and these GTC with withdrawal instructions (Widerrufsbelehrung) required by law in the event that a contract is concluded.
1.4. SilverBridges products may be individualised at the customer’s request, to the extent indicated in the online shop. For products individually manufactured according to customer specifications (in particular after selection and confirmation of your equipment details), no statutory right of withdrawal (Widerrufsrecht) exists (§ 312g para. 2 no. 1 BGB).
1.5. The acceptance of the contract by SilverBridges is effected by a separate order confirmation by e-mail. To the extent that the ordered WideluxX™ cannot be produced at all or in the version ordered by the customer, you will be informed thereof. In this case, a contract is not concluded; consideration already rendered will be refunded without delay.
2. Right of Withdrawal (Widerrufsrecht)
2.1. The right of withdrawal (Widerrufsrecht) is excluded if the WideluxX™ or another product of SilverBridges is individually adapted according to your specifications
(customer specifications) or is clearly tailored to your personal needs. This applies in particular to the engraving of your monogram or other personal characteristics that are clearly tailored by SilverBridges to your personal needs (§ 312g para. 2 no. 1 BGB). For clarification, for contracts concluded within the scope of the pre-sale of the WideluxX™ Panoramic Camera, the right of withdrawal (Widerrufsrecht) does not exist already by reason of the mandatory individualisation (monogram/initials engraving).
2.2. Customisations make the respective product a unique piece (Einzelstück) that cannot be used by third parties.
2.3. Please note that the exclusion of the right of withdrawal (Widerrufsrecht) is expressly agreed prior to conclusion of the contract and that SilverBridges documents the individual personalisation.
2.4. If you are a consumer, you have a right of withdrawal (Widerrufsrecht) in respect of products of SilverBridges not individualised according to customer specifications, in accordance with the statutory provisions.
2.5. If you as a consumer exercise your right of withdrawal (Widerrufsrecht), you shall bear the regular costs of return shipment.
2.6. In all other respects, the right of withdrawal (Widerrufsrecht) is governed by the provisions set out in detail in the following
Withdrawal Instructions (Widerrufsbelehrung)
Right of Withdrawal (Widerrufsrecht)
You have the right to withdraw from this contract (Vertrag) within fourteen days without giving any reason.
The withdrawal period (Widerrufsfrist) is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken or has taken possession of the goods.
To exercise your right of withdrawal (Widerrufsrecht), you must inform us, SilverBridges GmbH, Soonwaldstraße 21, 55494 Rheinböllen, registered in the commercial register (Handelsregister) of the local court (Amtsgericht) Bad Kreuznach under HRB 24214, +49 6032 9287057, withdrawal@wideluxx.com, by means of a clear declaration (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract (Vertrag). You may use the enclosed model withdrawal form (Muster-Widerrufsformular) for this purpose, which is however not prescribed. You may also complete and submit the model withdrawal form (Muster-Widerrufsformular) or another clear declaration electronically on our website https://wideluxx.com/. If you make use of this option, we will send you a confirmation of receipt of such a withdrawal without delay (e.g. by e-mail).
To observe the withdrawal period (Widerrufsfrist), it is sufficient that you send the notification of the exercise of the right of withdrawal (Widerrufsrecht) before the expiry of the withdrawal period (Widerrufsfrist).
Consequences of Withdrawal (Folgen des Widerrufs)
If you withdraw from this contract (Vertrag), we shall reimburse to you all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery
other than the least expensive standard delivery offered by us), without delay and at the latest within fourteen days from the day on which we received notification of your withdrawal from this contract (Vertrag). For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged fees on account of this reimbursement. We may refuse reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier point in time.
You must return or hand over the goods to us without delay and in any event no later than within fourteen days from the day on which you notify us of the withdrawal from this contract (Vertrag). The deadline is met if you send the goods before the expiry of the period of fourteen days.
You bear the direct costs of returning the goods.
You are only required to compensate for any loss in value (Wertverlust) of the goods if this loss in value is attributable to handling of the goods that is not necessary for testing the condition, properties and functioning of the goods.

3. Delivery Conditions, Shipping, Customs and Reservation of Advance Payment
3.1. Shipment takes place from Germany after completion and successful quality control; the delivery period is generally approximately five (5) working days and commences with the dispatch of the goods, i.e. after completion of production and passing of the quality control. Deviating delivery periods, in particular those pursuant to special provisions of these GTC (e.g. relating to the pre-sale), remain unaffected. An estimated delivery period will be communicated to the customer prior to conclusion of the contract.
3.2. In the case of pre-orders or customer-specific productions, in particular since the WideluxX™ is manufactured and assembled according to the customer’s wishes, the delivery period may be extended.
3.3. Delivery is subject to self-supply. Should a supply bottleneck occur due to missing components or delivery delays by suppliers, we reserve the right to adjust the delivery time accordingly.
In such a case, we will inform you without delay of the delay and the expected new delivery date.
3.4. For orders from customers with a residential or business address abroad or in the event of justified indications of a risk of payment default, we reserve the right to deliver only after receipt of the purchase price plus shipping costs (advance payment reservation (Vorkassevorbehalt)). If we make use of the advance payment reservation (Vorkassevorbehalt), we will inform the customer thereof without delay. In this case, the delivery period commences upon payment of the purchase price and the shipping costs.
3.5. The customer is expressly advised that the WideluxX™ is a product whose completion and delivery depends on the availability of all components and uninterrupted production. Unforeseen delays – in particular in the case of individual productions – cannot therefore be entirely excluded.
3.6. SilverBridges reserves the right, in business transactions with entrepreneurs within the meaning of § 14 BGB, to withdraw from the contract in the event of obvious typographical, printing or calculation errors in the offer or in the order confirmation.
3.7. Orders for delivery abroad are possible to the following countries:
- Member states of the European Union
- United Kingdom (UK)
- USA (including all states and US territories)
- South America: Chile, Uruguay, Costa Rica
- Africa: South Africa, Namibia, Botswana
- Asia: Singapore, South Korea, Japan, Taiwan, Thailand, Malaysia
- Australia & New Zealand
3.8. 3.8. For deliveries to countries outside the European Union, additional costs in the form of import duties, import sales tax and other official charges may arise at the place of destination. These costs are not included in the purchase price and are not borne by SilverBridges. They are to be paid by the customer on their own responsibility in the respective country of destination. SilverBridges has no influence on the amount of these charges; their calculation is governed by the customs and tax regulations of the respective country of destination. We recommend that customers outside the EU inform themselves prior to placing the order about the import regulations and costs applicable in the country of destination.
4. Prices and Shipping Costs
4.1. All price quotations are to be understood as gross prices inclusive of the applicable statutory value added tax and plus applicable shipping costs. The shipping costs will be bindingly displayed to you before the order is submitted.
4.2. If you effectively withdraw from your contractual declaration pursuant to clause 2, you may, under the statutory conditions, demand reimbursement of costs already paid for shipping to you (outward shipping costs (Hinsendekosten)).
5. Payment Conditions and Set-Off (Aufrechnung)
5.1. The prices stated in the online shop include the applicable statutory value added tax. The applicable shipping costs are shown separately during the order process and are transparently displayed prior to submission of the offer.
5.2. The customer may choose between various payment methods as indicated in the online shop and on the invoice. Accepted means of payment are in particular credit card. We reserve the right to make certain payment methods subject to a credit check or a maximum order quantity as well as to cease offering individual payment methods at any time and to refer to other payment methods.
5.3. The purchase price becomes due upon receipt of the order confirmation by SilverBridges. SilverBridges is entitled to withhold delivery until full receipt of the purchase price plus shipping costs (customer’s obligation to perform in advance (Vorleistungspflicht)). In the case of payment by advance payment, the delivery period does not commence until full receipt of payment by SilverBridges. In the case of payment by credit card or PayPal,
5.4. the purchase price is collected upon submission of the order; the delivery period commences upon conclusion of the contract by order confirmation.
5.5. Chargebacks attributable to the customer, in particular in the case of credit card payments, entitle us to charge the customer for the fees incurred. The amount of these fees depends on the respective means of payment and the credit institution and will be communicated to the customer on a case-by-case basis.
5.6. The customer is not entitled to set off (aufzurechnen) against our claims, unless the customer’s counterclaims have been established by final judgment, are undisputed, or are connected with complaints about defects (Mängelrügen) or with the same purchase contract.
6. Retention of Title (Eigentumsvorbehalt)
6.1. The delivered goods remain our property until full payment of the purchase price and all ancillary claims arising in connection with the order (such as, e.g., shipping costs).
6.2. Prior to transfer of ownership, any pledging, transfer of ownership by way of security (Sicherungsübereignung), processing or alteration of the goods without our express consent is not permitted.
6.3. The retention of title serves in particular to protect us against payment default in the case of individually manufactured high-quality products and to ensure financial security until full settlement of the purchase price.
7. Warranty
7.1. We are liable for material defects (Sachmängel) or legal defects (Rechtsmängel) of the WideluxX™ in accordance with the applicable statutory provisions, in particular pursuant to §§ 434 ff., 437 ff. BGB.
7.2. The customer is advised that defect claims (Mängelansprüche) do not exist if damages are attributable to improper use, operating errors, failure to observe the operating instructions, or third-party interference, in particular in the case of mechanical damage caused by forcible turning or improper handling of moving parts.
7.3. Entrepreneurs must notify obvious defects (offensichtliche Mängel) in writing within 10 days of receipt of the goods; otherwise the assertion of defect claims (Mängelansprüche) is excluded.
In the case of justified, timely notified defects, SilverBridges has the right to choose to remedy the defect either by subsequent performance in the form of repair (Nachbesserung) or replacement delivery (Ersatzlieferung) (subsequent performance (Nacherfüllung)).
If subsequent performance (Nacherfüllung) fails twice, the entrepreneur (Unternehmer) may, at their choice, demand a reduction of the purchase price (Minderung) or – in the case of material defects – withdraw from the contract. Further claims, in particular claims for damages, exist only in accordance with the liability limitations of these GTC.
7.4. The limitation period for statutory defect claims (gesetzliche Mängelansprüche) is two years and commences upon delivery of the WideluxX™ to the customer. For entrepreneurs within the meaning of § 14 BGB, the limitation period for defect claims (Mängelansprüche) is, by way of derogation, one year from delivery of the goods. This does not apply in the case of intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit) or for claims under the Product Liability Act (Produkthaftungsgesetz).
7.5. Any seller’s guarantees (Verkäufergarantien) given by us for certain items or manufacturer’s guarantees (Herstellergarantien) granted by us are in addition to the statutory claims for material defects (Sachmängel) or legal defects (Rechtsmängel) within the meaning of para. 1. The details and scope of such guarantees are set out in the guarantee conditions (Garantiebedingungen) pursuant to clause 8.
8. Manufacturer’s Guarantee (Herstellergarantie)
8.1. SilverBridges grants the first purchaser (i.e. the natural or legal person who originally and directly purchased the WideluxX™ from SilverBridges GmbH and is named in the original order confirmation) a voluntary manufacturer’s guarantee (freiwillige Herstellergarantie) of two (2) years from the date of delivery against manufacturing and material defects (hereinafter “guarantee”). This guarantee is personal and non-transferable and is in addition to the customer’s statutory claims for defects in goods (gesetzliche Sachmängelansprüche) pursuant to §§ 434 ff. BGB and does not replace them.
8.2. Scope of Guarantee Performance (Garantieleistung)
8.2.1. In the event of a guarantee claim (Garantiefall), SilverBridges is entitled and obliged to remedy the defect at its own choice by repair (Nachbesserung). The repair (Nachbesserung) is carried out exclusively by SilverBridges’ own technicians who are familiar with camera construction. Further guarantee claims – in particular for withdrawal from the contract, reduction of the purchase price (Minderung des Kaufpreises) or damages (Schadensersatz) – are excluded within the scope of this voluntary guarantee (freiwillige Garantie).
8.2.2. Grounds for Exclusion (Ausschlusstatbestände)
The guarantee (Garantie) expires if:
- Repairs, interventions or maintenance work on the WideluxX™ have been carried out by persons who have not been expressly authorised by SilverBridges. Only the assembly technicians and service technicians of SilverBridges GmbH as well as any service partners named in writing by SilverBridges are deemed to be authorised.
- The damage is attributable to improper handling, operating errors, failure to observe the operating instructions or mechanical use of force.
- Modifications have been made to the product that have not been approved by SilverBridges.
8.2.3. Guarantee Process (Garantieprozess)
To make use of the guarantee (Garantie), please contact: warranty@wideluxx.com, providing your order number, a description of the fault and the date of purchase. SilverBridges will examine the reported defect and, in the event of an acknowledged guarantee claim (anerkannter Garantiefall), will bear the costs of the repair (Nachbesserung) including shipping.
8.3. Service Outside the Guarantee Period (Garantiezeit)
8.4. After expiry of the guarantee period (Garantiezeit), SilverBridges offers, upon request, a paid repair and maintenance service. The costs will be communicated to the customer in a cost estimate (Kostenvoranschlag) prior to commencement of the work and require the express consent of the customer.
9. Liability (Haftung)
9.1. SilverBridges is liable to you in all cases of contractual and non-contractual liability (außervertragliche Haftung) for intent (Vorsatz) and gross negligence (grobe Fahrlässigkeit) in accordance with the statutory provisions for damages (Schadensersatz) or reimbursement of futile expenditure (Ersatz vergeblicher Aufwendungen).
9.2. In all other cases – unless otherwise provided in para. 3 – we are liable only in the event of a breach of a contractual obligation (Vertragspflicht) whose fulfilment is what makes proper performance of the contract possible in the first place and on the observance of which you as a customer may regularly rely (so-called cardinal obligation (Kardinalpflicht)), limited to compensation for the foreseeable and typical damage. In all other cases, liability is excluded.
9.3. Our liability for damages arising from injury to life, body or health as well as under the Product Liability Act (Produkthaftungsgesetz) remains unaffected by the foregoing limitations and exclusions of liability (Haftungsbeschränkungen und -ausschlüsse).
9.4. Liability for damages caused by improper handling, manipulation or use of the WideluxX™ not in accordance with its intended purpose is excluded to the extent permitted by law. This applies in particular to damages caused by forcible operation or disregard of the operating and care instructions.
9.5. The foregoing liability provisions do not affect the customer’s statutory warranty rights (gesetzliche Gewährleistungsrechte).
10. Transport Damages
10.1. If the WideluxX™ is delivered with obvious shipping damage, the customer is requested to report such damage immediately to both SilverBridges GmbH and the shipping insurer designated by SilverBridges: Secursus, 99 Avenue Achille Peretti, 92200 Neuilly-Sur-Seine, Frankreich, contact@secursus.com. To preserve evidence and safeguard any potential claims, it is also recommended that the damage be documented with the delivery agent.
10.2. Failure to notify SilverBridges or the shipping insurer has no effect on the customer’s statutory warranty rights, in particular the claims for defects pursuant to Section 7 of these Terms and Conditions.
10.3. The customer’s cooperation, particularly by providing documentation or photos, assists SilverBridges in reporting the damage to the shipping insurer and may expedite the processing of the claim.
11. Copyrights (Urheberrechte)
11.1. All copyrights (Urheberrechte) and other protective rights (Schutzrechte) in the images, films, texts, product descriptions and technical drawings used in our online shop, our social media channels (in particular but not exclusively Instagram/Reddit/YouTube) or in other presentations, in particular relating to the WideluxX™ manufactured by us, belong to us or our licensors.
11.2. Any use, in particular reproduction, distribution , making publicly accessible, editing or transmission of the aforementioned content without our express prior consent is impermissible and constitutes a violation of copyright.
11.3. This applies in particular to the use of technical drawings, manuals and product illustrations of the WideluxX™ for other commercial purposes (e.g. advertising, resale, training materials), to the extent that these have been provided by us.
11.4. Use of content created or made available by us is permissible exclusively within the scope of the contracts concluded with us and for the private use of the customer.
12. Data Protection Notice (Datenschutzhinweis)
12.1. We collect, process and use your personal data, in particular your contact data as well as product-specific data – e.g. relating to ordered equipment variants, individualisation requests and serial numbers – exclusively for the purpose of contract processing and customer care. The legal basis for this is Art. 6 para. 1 lit. b) GDPR (DSGVO).
12.2. If your consent is available, we also use your e-mail address to send product-specific information, updates and safety-related notices regarding the WideluxX™ purchased.
12.3. For the purpose of a credit check (Bonitätsprüfung), we may obtain information, including a so-called score value (Score-Wert), from external service providers as a decision-making aid and make the possible payment method dependent thereon. For this purpose, we may also use address information.
12.4. Personal data will be passed on to shipping service providers, payment services and, if applicable, production partners (e.g. in the context of special productions) to the extent necessary for the fulfilment and delivery of the contract.

13. Applicable Law and Place of Jurisdiction, Dispute Resolution (OS Platform)
13.1. The law of the Federal Republic of Germany shall apply, to the exclusion of the UN Sales Law (UN-Kaufrecht). If you have placed the order as a consumer and at the time of your order have your habitual residence in another country, the application of mandatory statutory provisions of that country shall remain unaffected by the choice of law made in sentence 1.
13.2. If you are a merchant and have your registered office in Germany at the time of the order, the exclusive place of jurisdiction shall be the registered office of the seller, Bad Kreuznach. In all other respects, the applicable statutory provisions shall apply with regard to local and international jurisdiction.
13.3. The German version of these GTC is authoritative; all other translations serve merely for comprehension purposes.
13.4. In the event of disputes regarding contractual obligations arising from online contracts between SilverBridges and the customer, we inform you that the European Commission has developed and offers a portal for online dispute resolution (OS platform) so that disputes between seller/service provider and consumer can be settled out of court. The OS platform is accessible via the following link: https://ec.europa.eu/consumers/odr/ . Via this platform, the
customer may lodge a complaint regarding the online purchase contract or online service contract.
The above-mentioned website contains all necessary information regarding the submission of a complaint and the corresponding procedure.
We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
